Publishing Ads
Do you need the permission of the ad-maker to re-publish their ad? Or do ads fall under public domain?
Any one have any idea about it? (I know many people have compiled and sold swipe files without asking for the ad makers permission. And there are quite a few websites that showcase video ads. And most advertisers shouldn't have any problem because you are after all giving them more ink. But would want to know if you have any knowledge about the issue...) |

As you mentioned Many have done it in some form or another, so I guess it all depends on who you ask... And should the Ad copyright belong to the Advertiser who writes the Ad or the Publisher who usual owns the actual publication, web site etc... Just one example... Unlimited possibilites for those that have those Creative and Innovative ideas... :) And willing to "quietly" Test particular Legal issues... Maybe nothing to worry about... Depends...
If you were to copy the ads and use them to TEACH a principle then they could be used under "fair use". Be sure and attribute.
A few years ago I created a short course on email marketing and used some of the emails I had been sent by marketers. I printed out the emails and then edited them, and used them to illustrate both bad and good points to my clients. It's always good to have permission to avoid lawsuits. Aloha, Jason |

Thanks. I have a very Different Perspective on this. Just Suppose you wanted to borrow an ad word for word? That would be STUPID. Because Joe Sugarman - among others - teaches us that You CANNOT MAKE MUNNY by doing the same thing Twice. Even if it's your own ad! You will have to test, change and tweak any best selling ad you find. So you don't even have to THINK about a possible lawsuit. CUZ Stealing Ads Word for word is a path to the poor house. AND Just Suppose you wanted to SHARE an ad or a Booklet full. Or fill a book full of proven ads and SELL that book? Every darn tootin' entrepreneur whose ad & offer You are sharing with EVEN MORE BUYING PROSPECTS. Will Jump and holler for joy. KISS you on the cheek. Or - SHAKE Your Hand. Because you are helping him/her get his ad in front of 1000's more people - that he might never have reached before. So. Ankesh - share and sell and write about ALL the ADS and Sales letters you want to. IN THE SPIRIT of Helping the Ad Writers and Sales ltr authors get their message and offer in front of MORE PROSPECTS. They will LOVE you for it! Thanks everyone for the advice.
My problem is: I am preparing a presentation and there are a few ads that would be awesome to use as examples. But I have no clue who the creators of those ads are. Most of these ads don't promote products. They are guerilla ads (mainly grafitti and billboards) and have to do with social causes. For eg: one ad is on why drugs is bad. But it doesn't say which company sponsored that ad or mention any name what so ever... So I was wondering if I should use these ads or not... I'll probably end up using them and give a disclaimer in the last slide or something... Thanks. |
