I want liability protection and privacy which I can't get through the state I live in so I'm considering a New Mexico LLC as Offshore Banking site recommends. Opinions? |

Hi! Donna here. It's always great to get referrals before you commit and I commend you for this. I just wanted you and everyone else to know that for incorporations, and LLCs in 49 states, I send customers to my affiliate link at bizfilings and for NM LLCs, I have an associate that does them. We do the NM LLCs especially as a privacy tool. NM does NOT require principal names to be listed, whereas most every other state does. Wyoming is the best one for incorporations when considering privacy. Why? Currently, they are the only state that does NOT require Directors to be listed in the Articles of Incorporation. Furthermore, unlike NV and Delaware, it does not require a corporate identifier (Inc., Ltd., Corp., etc.). In other words, you can list your company as 'Donna Palen' and that'd be incorporated, but you wouldn't know that because there is no Inc. behind it. And just in case one of you are considering NV or Delaware, they are NOT as low cost as they once were. NV has consisently raised their state filing fee, and now have an annual franchise fee (Another word for TAX). And with Delaware, the low cost does NOT include the corporate kit or ANY extras, such as Resident Agent (required). And if you are looking for limited liability when in comes to incorporating, you should be incorporated in your home state as well. Two reasons that one would use a corporation over a Limited Liability Company is; A) The tax savings and perks (i.e. medical plan) B) To reveal it's a legal entity rather than a real person. This is not available for LLCs, as they MUST end in LC or LLC or similar. A LLC can open a bank account just as a corporation can. Last note, my affiliate link DOES make you give the names of all involved, even for NM LLCs or WY Corps. So I wouldn't go thru them if privacy is what you are aiming for.
